Kraken Requests Jury Trial in SEC Lawsuit
On September 13, according to CoinDesk, cryptocurrency exchange platform Kraken has requested a jury trial in a lawsuit filed by the U.S. Securities and Exchange Commission (SEC), according to court documents filed Thursday.
Last month, a California judge ruled that the SEC's lawsuit against Kraken would proceed to trial. This ruling came after the agency filed similar lawsuits against Binance and Coinbase, which also face accusations of violating federal securities laws by failing to register with the SEC as brokers, clearing agencies, or exchanges.
In November last year, the SEC sued Kraken in the Northern District of California, seeking a permanent injunction barring the exchange from further securities law violations, along with disgorgement of its "ill-gotten gains" and other civil penalties. The regulator listed ADA, ALGO, ATOM, FIL, FLOW, ICP, MANA, MATIC, NEAR, OMG, and SOL tokens as 11 unregistered securities.
In Thursday's court filing, Kraken reiterated its position that it did not engage in illegal activity, responded to each allegation in the SEC lawsuit, and raised 18 additional defenses.
